By accessing and using Promall ("the Platform"), you accept and agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.

These terms apply to all users of the Platform, including without limitation, users who are browsers, customers, merchants, and/or contributors of content.

Promall is an integrated real estate marketplace that provides:

• Property listings for sale and rent across Malawi
• Accommodation booking services (hotels, lodges, vacation rentals)
• Marketplace for real estate-related products and services
• Professional directory connecting users with verified real estate professionals
• Educational content and resources through Promall TV and Learning Centre
• Advertising and promotional services for businesses

We reserve the right to modify, suspend, or discontinue any aspect of our services at any time without prior notice.

To access certain features of the Platform, you must create an account. When creating an account, you agree to:

• Provide accurate, current, and complete information
• Maintain and promptly update your account information
• Maintain the security and confidentiality of your password
• Accept responsibility for all activities that occur under your account
• Notify us immediately of any unauthorized use of your account

We reserve the right to suspend or terminate accounts that violate these terms or engage in fraudulent or illegal activities.

Users who list properties, accommodations, or products on Promall agree to:

• Provide accurate and truthful descriptions of their listings
• Include only authentic images that represent the actual property or product
• Disclose all material facts and any known defects
• Comply with all applicable laws and regulations in Malawi
• Not engage in deceptive or misleading practices
• Respond to inquiries in a timely and professional manner

Promall reserves the right to remove any listing that violates these terms or our community guidelines without prior notice.

Users of Promall are prohibited from:

• Posting false, misleading, or fraudulent content
• Impersonating any person or entity
• Engaging in any illegal activities or promoting illegal services
• Harassing, threatening, or intimidating other users
• Attempting to gain unauthorized access to our systems
• Using automated systems to scrape or collect data
• Interfering with the proper functioning of the Platform
• Violating the intellectual property rights of others
• Engaging in money laundering or terrorist financing activities

Violation of these prohibitions may result in immediate account termination and potential legal action.

For subscription-based services and payments:

• All fees are quoted in Malawian Kwacha (MWK)
• Subscription fees are billed in advance on a monthly, quarterly, or annual basis
• Refunds are subject to our refund policy and are evaluated on a case-by-case basis
• We reserve the right to change our pricing with 30 days' notice
• Failure to pay may result in suspension of services

Users are responsible for ensuring their payment information is accurate and current.

Promall is a marketplace platform that connects users. We do not own, manage, or control the properties, products, or services listed on our platform.

To the maximum extent permitted by law:

• We are not liable for any indirect, incidental, or consequential damages
• We do not guarantee the accuracy of listings or user-provided content
• We are not responsible for transactions between users
• Users engage with each other at their own risk
• We recommend conducting due diligence before any transaction

Users are encouraged to verify all information independently and seek professional advice when necessary.

All content on Promall, including but not limited to text, graphics, logos, images, and software, is the property of Promall or its content suppliers and is protected by intellectual property laws.

Users retain ownership of content they submit but grant Promall a non-exclusive, worldwide, royalty-free license to use, display, and distribute such content in connection with our services.

Users may not reproduce, distribute, or create derivative works from our content without express written permission.

We may terminate or suspend your account and access to the Platform immediately, without prior notice or liability, for any reason, including but not limited to:

• Breach of these Terms of Service
• Violation of applicable laws or regulations
• Fraudulent or illegal activities
• Harmful behavior towards other users or the Platform

Upon termination, your right to use the Platform will immediately cease. All provisions of these terms that should survive termination shall survive.

These Terms of Service shall be governed by and construed in accordance with the laws of Malawi, without regard to its conflict of law provisions.

Any disputes arising from these terms or your use of the Platform shall be subject to the exclusive jurisdiction of the courts of Malawi.

If any provision of these terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
